Terms of Service (TOS) for Mist Software

This document outlines the terms of use for Mist, including MistCentral, Mist Launcher, Mist CLI, Mist Client, and associated subdomains, utilities, and services (collectively referred to herein as the "Software"). By accessing or using this Software, you ("User," "You," or "Your") and Herwork (also known as Herwork_dev), the creators of Mist, agree to adhere to the following terms:

1. User Acceptance and Agreement:

   • No explicit agreement is required. Use of the Software constitutes acceptance of these terms.

2. User Conduct:

   • Users are permitted to download and utilize the provided utilities. Reverse engineering or modifying software/game mods is prohibited.

3. Account Creation and Security:

   • No user accounts are required or created for the Software.

4. Intellectual Property Rights:

   • Users are not contributing content. Respect intellectual property rights and refrain from unauthorized copying or modification.

5. Privacy and Data Handling:

   • We collect limited IP information (logs, geolocation, browser headers) through Cloudflare DNS for analytical purposes. For elaboration on collected data, refer to our Privacy Policy.
   • No use of cookies; user data is stored for analytics and metrics.

6. Service Changes and Availability:

   • Users are informed of updates via blog posts, Twitter, or within the app.
   • Downtime information available at status.mist.tf. The app won't function without API availability.

7. Payment (if applicable):

   • No payments or premium services are involved at this time.

8. Liability and Disclaimers:

   • The Software is not liable for illegal user activities or modifications.
   • No third-party content is used, but games (source mods) are distributed for ease of access.

9. Account Termination/Suspension:

   • No accounts are associated with the Software; termination or suspension is not applicable.

10. Governing Law and Dispute Resolution:

    • Norwegian laws govern this agreement.
    • Disputes: We aim to avoid conflicts; disputes not taken to court. Address issues on social media but prefer resolution without legal involvement.
